Payer/End-user Terms
1. Scope
Payer/End-User shall mean any person or entity who uses Payop to pay for the goods and services of the Merchant and has accepted these Payer/End-user Terms (“Terms”) in its entirety, and has the right and authority to bind oneself to these Terms and not barred or otherwise legally prohibited from accessing or using Payop and who uses/used Payop as a payment method on Merchant’s website to purchase Merchant’s goods or services.
If you are using Payop as a payment method to purchase goods or services from certain Merchant you fully and implicitly accept these Payer/End-user Terms and any Legal Terms & Policies applicable to you as a Payer/End-user. If you do not agree to any of the provisions of these Payer/End-user Terms and any Legal Terms & Policies applicable to you as a Payer/End-user, do not use Payop.
2. Payer/End-User Consent
The Payer/End-User accepts these Terms and Payer/End-user agrees that Payop’s role starts when the Payer initiates the payment and ends when the payment is successful. Payer/End-User agrees that Payop cannot be considered as any party of the transaction between the Payer/End-User and the Merchant. Payer/End-User agrees that Payop is not responsible for the Payer/End-user’s payments except only technical transaction support. Payer/End-user agrees that Payop does not give any payment guarantee for them, does not bear any responsibility with respect to such payments and does not support in case of any issues that may arise by using the payment platform. Payer/End-user agrees to address any transaction related claims directly to the Merchant and that Payop shall not act as a representative/guarantor/mediator of neither party.
Payer/End-user also confirms that they use their funds at their own discretion, purchase the services/products from the Merchant by their own choice and shall address the Merchant to demand a refund, file complaints for improper provision of services/non-provision of services by the Merchant who acts as a party in the provision of services to the Payer/End-user.
Payer/End-user shall familiarize with information considering transaction disputes/refund requests, and other related information on the Website in good faith.
Payer/End-user acknowledges that Payop may assist Payer/End-User in technical issues considering the transaction.
The fact that a person or entity accepts payments through Payop is not an indication of the legality of the supply or provision of their goods and services. If the Payer/End-user is in doubt as to the legality of a supply or purchase, they should not continue with the payment, otherwise Payop shall not in any event be held liable for any damages and/or losses incurred by the Payer/End-user.
3. Prohibited actions
Payop shall act accordingly in case Payer/End-user is abusing their right to dispute the transaction by initiating irrelevant claims/chargebacks/disputes. Payop reserves the right to take any measures against chargeback dispute abuse, chargeback fraud, friendly fraud, defamation initiated by the Payer/End-user. Payer/End-user further confirms that such acts may cause irreparable damages to Payop and Payer/End-user shall be liable for any damages/losses suffered by Payop as a result of Payer’s/End-user’s chargeback dispute abuse, chargeback fraud, friendly fraud, defamation. Payop also reserves the right to report Payer’s/End-user’s actions to authorities subject to investigation of Payer/End-user’s illicit activity.
It is strictly prohibited to make any payments using a third-party payment credentials or stolen payment credentials (for avoidance of doubt, it is strictly prohibited to make any payments with any payment methods which do not belong to the Payer/End-user who is the beneficiary of the transaction). We reserve the right to forward fraud cases to the relevant law enforcement agency to fight fraud and stop and fraudulent actions.
It is strictly prohibited to use different payment methods and credentials in case you have been blocked by Payop for any payment abuse (e.g. creation of multiple accounts to bypass the email/IP/credentials block imposed by Payop). In case we detect such activity Payop reserves the right to block, suspend and adjust any further payment amounts paid from such abuses.
Payop reserves the right not to address/respond to any inquiries related to the abuse of Payop system (including spam, flood, defamation and other forms of online abuse).
